A Texas father is suing a California doctor for “wrongful death” after he illegally mailed abortion pills that were used by his married lover to end two of their pregnancies, according to a lawsuit filed in federal court.

Texas Attorney General Ken Paxton on Monday asked a court to make a New York county enforce a $100,000 judgment against a doctor for sending abortion pills to Texas, taking an unprecedented interstate conflict to court.

Texas has not banned abortion pills entirely, and the Supreme Court has previously upheld access to those medications when parties have sued the Food and Drug Administration. A ban stalled in the Texas House earlier this year.
